1. Acceptance of Terms

These Terms of Service govern use of the website, platforms, and services made available by Global Psychoeducational Solutions (“GPS,” “we,” “us,” or “our”). By accessing or using our website, communicating with us through website forms, email, or related platforms, or engaging our services, you agree to these Terms to the extent applicable. If you do not agree, you should not use the website or services.

2. Scope of Services

GPS provides psychoeducational evaluations and related consultative services, which may include comprehensive evaluations, independent educational evaluations (IEEs), school- or district-based support, consultation, and related professional services. Services are provided in accordance with applicable licensure, professional standards, and the terms of the specific engagement.

GPS does not provide psychotherapy, psychiatric services, emergency services, or ongoing medical treatment through these services.

3. Website and Platform Use

Our website, client portal, telepractice platforms, and related systems may be used for communication, scheduling, document exchange, intake, and, where applicable, service delivery. You agree to use these systems only for lawful purposes and in a manner consistent with these Terms.

  • You are responsible for providing accurate information when submitting inquiries or materials.
  • You must maintain the confidentiality of any login credentials or access information provided to you.
  • You may not attempt to gain unauthorized access to restricted systems, accounts, or information.
  • GPS may suspend or restrict access where necessary to maintain security, compliance, or operational integrity.

4. Telepractice and Remote Services

Where remote services are offered, GPS may use secure telepractice or related digital platforms to conduct portions of service delivery. Use of remote services may be subject to additional consent, disclosure, or procedural requirements.

Remote sessions are not recorded unless expressly disclosed and authorized in writing.

5. Client and Customer Responsibilities

  • Families, adult clients, schools, districts, and other engaging parties are responsible for providing accurate information, records, consents, and authorizations necessary for service delivery.
  • When a school or district engages GPS, the engaging entity is responsible for ensuring it has authority to share relevant records and information.
  • You agree not to misuse, disrupt, or interfere with the website, platforms, or services.

6. Fees and Payment

Fees, payment terms, deposits, cancellation terms, and any refund terms are governed by the applicable written engagement agreement, invoice, or service arrangement. Payments are due as stated in the governing engagement materials.

GPS may use secure third-party payment processors. Use of those providers may also be subject to the provider’s own terms and privacy practices.

7. Privacy and Confidentiality

Use of the website and services is also subject to our Privacy Policy. The Privacy Policy describes how information is collected, used, disclosed, and protected. In the event of a conflict between these Terms and the Privacy Policy regarding data handling, the Privacy Policy governs with respect to privacy practices.

8. Intellectual Property

Unless otherwise stated, website content, branding, logos, written materials, report formats, assessment-related work product, and related content made available by GPS are owned by GPS or its licensors and are protected by applicable intellectual property laws.

No portion of the website or services may be copied, reproduced, distributed, modified, published, or used for commercial purposes without prior written permission, except as permitted by law, contract, or the intended professional use of evaluation reports by authorized recipients.

9. Educational and Professional Materials

Evaluation reports may be provided for the use of authorized recipients in connection with educational planning, review, or related purposes. Assessment instruments, protocols, raw materials, scoring materials, and other protected testing content are not transferred or licensed except as required by law or professional obligation.

10. No Guarantee of Outcome

GPS does not guarantee any specific educational, legal, admissions, eligibility, accommodation, or other outcome arising from the use of its services. Recommendations, interpretations, and conclusions are professional opinions based on the information available at the time of service.

11. Disclaimer of Warranties

To the fullest extent permitted by law, the website and related online systems are provided on an “as is” and “as available” basis. GPS makes no warranties, express or implied, regarding uninterrupted access, error-free operation, or the availability of the website or related systems at all times.

12. Limitation of Liability

To the fullest extent permitted by law, GPS shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to the use of the website, platforms, or services.

To the extent liability is not otherwise excluded, GPS’s total liability arising from a particular claim shall not exceed the amount paid to GPS for the specific service giving rise to that claim, unless otherwise required by law.

13. Indemnification

You agree to indemnify and hold harmless GPS and its officers, employees, contractors, and agents from claims, liabilities, losses, damages, or expenses arising out of your misuse of the website or services, your violation of these Terms, or your unlawful or unauthorized use, disclosure, or distribution of materials or information, except to the extent caused by GPS’s own negligence, willful misconduct, or other liability that cannot be waived under applicable law.

14. Force Majeure

GPS shall not be responsible for delay, interruption, or failure in performance resulting from causes beyond its reasonable control, including illness, emergency, natural disaster, public health event, labor dispute, internet or power outage, governmental action, platform outage, or other similar events.

15. Third-Party Services

The website and services may involve third-party platforms, providers, or links. GPS is not responsible for the content, terms, availability, or privacy practices of third-party services except as otherwise required by law or contract.

16. Dispute Resolution

The parties agree to attempt to resolve disputes in good faith before initiating formal proceedings. Where a written engagement agreement contains dispute resolution terms, those terms govern. In the absence of a controlling written agreement, disputes arising from these Terms shall be governed by applicable law and resolved in a court or forum of competent jurisdiction, unless arbitration is separately agreed to in writing or otherwise required by law.

17. Governing Law

These Terms shall be governed by the laws of the State of Illinois, without regard to conflict of law principles, except to the extent superseded by federal law or otherwise modified by a written agreement or applicable law.

18. Severability

If any provision of these Terms is held to be invalid, unenforceable, or unlawful, the remaining provisions shall remain in full force and effect to the fullest extent permitted by law.

19. Entire Agreement

These Terms, together with any applicable written engagement agreement, consent form, invoice, or incorporated policy, constitute the agreement governing website and service use to the extent applicable. If there is a conflict between these Terms and a specific written service agreement, the written service agreement controls for that engagement.

20. Changes to These Terms

GPS may revise these Terms from time to time. Updated versions will be posted with a revised “Last updated” date. Continued use of the website or services after changes are posted constitutes acceptance of the revised Terms to the extent permitted by law.
