Professional use of our services
1. Acceptance of Terms
By accessing or using Global Psychoeducational Solutions’ (“GPS”) website, client portal, telepractice platforms, or related services (collectively, the “Services”), you agree to these Terms of Service. If you do not agree, you must discontinue use.
2. Scope of Services
GPS provides psychoeducational services including comprehensive evaluations, independent educational evaluations (IEEs), district backlog support, and admissions reviews. These services are not psychotherapy or medical treatment. All services are provided under applicable licensure and professional standards.
3. Client Portal & Telepractice
- Our secure client portal and telepractice platforms are provided for scheduling, document exchange, and remote assessments.
- You must keep access credentials confidential and not permit unauthorized use.
- GPS may suspend access if security or compliance is compromised.
- Telepractice sessions are not recorded unless expressly disclosed and consented to in writing.
4. Responsibilities
- Families engaging GPS must provide accurate records and valid consents.
- Districts must ensure lawful authority to share student records for IEEs or backlog services.
- You agree not to misuse or attempt unauthorized access to the Services.
5. Fees & Payment
Fees are governed by written agreements. Payments are due as invoiced. GPS may use secure third-party processors. Refunds, if any, are as specified in engagement terms.
6. Confidentiality & Privacy
Use of our Services is also governed by our Privacy Policy, which explains our data practices. In case of conflict, the Privacy Policy governs handling of personal information.
7. Intellectual Property
All content on our website, portal, and reports is owned by GPS or its licensors. You may not reproduce or distribute it without written consent, except as allowed by law or contract.
8. Limitation of Liability
To the fullest extent permitted by law, GPS shall not be liable for indirect or consequential damages. Total liability for any claim shall not exceed the amount paid for the specific service.
9. Dispute Resolution
Disputes must first be addressed through good-faith negotiation. If unresolved, they shall be subject to binding arbitration under Illinois law, unless otherwise required by applicable law.
10. Governing Law
These Terms are governed by the laws of the United States, the State of Illinois, and, where applicable, the State of Florida.
11. Indemnification
You agree to indemnify, defend, and hold harmless GPS and its staff from any claims, liabilities, damages, or expenses arising from your misuse of Services, improper sharing of reports, or breach of these Terms, except to the extent caused by GPS’s own negligence or misconduct.
12. Force Majeure
GPS is not liable for any delay or failure in performance resulting from causes beyond our reasonable control, including illness, emergencies, natural disasters, pandemics, labor disputes, internet outages, or government restrictions.
13. Severability & Entire Agreement
If any provision of these Terms is held invalid, the remaining provisions remain in effect. These Terms, together with any written engagement agreement, constitute the entire agreement between you and GPS regarding the Services.
14. Changes
We may revise these Terms. Updates will be posted with a revised “Last updated” date. Continued use constitutes acceptance.
